What's specific to Palo Alto

The exempt list is specific about decks and silent on railings. Palo Alto's current exemption (Municipal Code § 16.04.110, Ordinance 5674, adopting the 2025 codes) covers "wood decks not over 30 inches above surrounding grade or finishes, not attached to a structure, or serving any part of the means of egress." All conditions apply together: a deck attached to the house is not exempt regardless of height, and a railing on it is a question for the Building Division.

Eichler homes. Palo Alto has more than 2,000 Eichler homes in 31 tracts (City of Palo Alto, Eichler Design Guidelines, 2018). The guidelines are voluntary. If the original rail detail matters to you, photograph it before it comes off and say so in the request; the Eichler Design Guidelines describe the original details. The code sets height and openings, not style.

Before the contractor calls

  • Note whether the deck is attached to the house; it decides the permit question.
  • Photograph the rim joist and one post base.
  • If Eichler: photograph the existing rail detail.

Does Palo Alto require a permit to add a railing to an existing deck?

Railings are not on the city's exempt list, and an attached deck is not exempt at any height. Ask the Building Division; the contractor can.

Can a railing keep an Eichler look and still meet code?

The code sets 42 inches and the 4-inch opening limit, not the style. Send a photo of the existing detail with the request.
