1. What this Site is. The Site is an advertising and referral service. We publish information about fence, gate and deck repair and forward homeowner requests to independent contractors who advertise with us. We are not a contractor, home improvement salesperson, broker or agent of any contractor. We do not perform, supervise, estimate, price, schedule or guarantee any work.
2. Contractors are independent. Each contractor who receives requests through the Site is an independent business, not our employee, partner, subcontractor, franchisee or joint venturer. We do not control and have no right to control a contractor's pricing, methods, materials, schedule, employees, subcontractors, permits or performance. Each contractor is solely responsible for its own licensing, bonding, insurance, permits and compliance with law. Contractor information, if any, is supplied by the contractor. We may consult public records but do not guarantee that any license, insurance, classification or qualification is current or appropriate for your project. Verify directly with the California Contractors State License Board (cslb.ca.gov) before hiring. Contractors may pay us for advertising and referral services.
3. Your transaction is with the contractor only. We are not a party to any estimate, proposal, contract, change order, payment, warranty or dispute. The contractor and you are solely responsible for compliance with all laws applicable to your transaction.
4. How requests are handled. When you call a number shown on the Site, your call is forwarded to the one independent contractor assigned to the area shown on that page. When you submit the request form, your name, phone number, city, description and photos are sent to that contractor, who may contact you by phone, text or email. We store your request, may listen to voicemail and read transcriptions, and may send you one informational text if the contractor misses your call (see SMS Terms). We send each request to one contractor only. If that contractor is unavailable, we will ask you before referring your request to another contractor.
5. No guarantees. We do not guarantee that a contractor will respond, be available, offer any price or complete any work. Information on the Site about permits, codes, costs and repair methods is general, may be outdated or incomplete, and is not legal, engineering or contracting advice.
6. Communications. By calling or texting a number on the Site, or submitting the form, you consent to be contacted by the assigned contractor and by us about your request. Message and data rates may apply. Reply STOP to end text messages from us. See SMS Terms.
7. Disclaimer of warranties. THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THE QUALITY, SAFETY, LEGALITY OR TIMELINESS OF ANY CONTRACTOR'S WORK.
8. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM WORK PERFORMED OR NOT PERFORMED BY A CONTRACTOR. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
9. Release. You release us from any claim, demand or damage arising out of or connected with any dealing between you and a contractor. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
10. Acceptable use. Use the Site only to request services for property you own or are authorized to manage. No scraping, automated requests, false information or use of the Site to solicit contractors for other purposes.
11. Intellectual property. Site content, photos and text are owned by the operator or used with permission.
12. Disputes. California law governs. Disputes with us are resolved in the state or federal courts in Santa Clara County, California, or in small claims court.
13. Changes. We may update these Terms by posting a new version with a new effective date.
